Terms and Conditions

§ 1 Preliminary Provisions

  1. The Fragrant Beauty online store, available at https://fragrantbeauty.be, is operated by: K.Z. Fragrant Beauty

  2. These Terms and Conditions are addressed to both consumers and entrepreneurs using the Store. They define the rules of using the online store and the procedure for concluding distance sales contracts.
  3. The administrator of personal data processed in the Store is the Seller. Data is processed in accordance with the GDPR and the Belgian Act of 30 July 2018 on the protection of individuals with regard to the processing of personal data.

§ 2 Information Obligation

These Terms and Conditions include:

  • rules for registration and account creation,

  • ordering procedures,

  • payment and delivery terms,

  • return and complaint policy,

  • information duties under the Belgian Economic Code,

  • terms of electronic service provision.

§ 3 Definitions

  • Consumer – a natural person concluding a contract for purposes not related to business activity.

  • Seller – K.Z. Fragrant Beauty

  • Customer – any person placing orders in the Store.

  • Store – the online store operated at https://fragrantbeauty.be

  • Distance contract – a contract concluded without the physical presence of the parties.

  • Terms and Conditions – this document.

§ 5 Personal Data Protection

  1. Customers’ personal data is processed in accordance with the GDPR and Belgian law.
  2. Data may be shared with logistics and payment service providers.
  3. Customers have the right to access, rectify, restrict, or delete their data.

§ 6 Technical Requirements

To use the Store, the following are required:

  • a device with internet access,

  • a web browser,

  • an active e-mail account,

  • cookies and JavaScript enabled.

§ 7 Orders and Payments

  1. Orders can be placed via the Store’s website 24/7.
  2. Payment methods: bank transfer, credit/debit card, Bancontact, Apple Pay, Google Pay.
  3. Delivery is handled by local carriers: DPD and other couriers.
  4. The Store is not responsible for non-delivery or delivery delays caused by incorrect or incomplete delivery addresses or missing information necessary for order fulfillment.
  5. The Seller reserves the right to suspend the order if false or questionable information is provided. In such cases, the Seller will attempt to contact the customer to verify the data, if possible.

§ 8 Right of Withdrawal

  1. The Consumer has the right to withdraw from the contract within 14 days of receiving the goods without giving any reason, in accordance with Articles VI.47–VI.53 of the Belgian Economic Code.
  2. Return shipping costs are borne by the Customer.
  3. Returned items must be sent within 14 days of the withdrawal declaration.
  4. A refund will be issued within 14 days.
  5. The withdrawal period begins on the day the order is delivered. Please note: returned items must be in their original, sealed packaging and unused.
  6. The Customer is liable for any diminished value of the returned goods if used beyond what is necessary to assess their nature, characteristics, and functioning.

§ 9 Complaints

  1. The product must comply with the contract in accordance with Articles VI.96/5 and following of the Belgian Economic Code.
  2. Complaints can be submitted via email or by post.
  3. The Seller undertakes to process the complaint within 14 days.

§ 10 Final Provisions

  1. The Terms and Conditions are available free of charge on the Store’s website.
  2. In matters not covered herein, Belgian law shall apply.
  3. The Customer may use the EU’s ODR platform: https://ec.europa.eu/consumers/odr

These Terms and Conditions are effective from the date of their publication on the Fragrant Beauty online store website.
